What Does "Up to X% Off" Actually Mean?
"Up to X% off" legally only requires that at least one item in the sale be discounted that much — most items are typically discounted far less, often in the 10-30% range even when the banner advertises 'up to 70% off.'

Why the headline number is technically true but misleading
'Up to 70% off' is satisfied if a single clearance item, in one size, in one color, meets that discount — the phrase makes no claim about the average or typical discount across the sale. Most shoppers reasonably read 'up to 70% off' as implying most items are near that number, which is exactly the impression the phrasing is designed to create without technically promising it.
An $80 item marked down 20% (to $64) is a completely ordinary outcome inside a sale banner promising 'up to 70% off' — the headline number and the actual discount on any specific item you're looking at can be very different.
How to check the real discount
Compare the item's current price against its regular (non-sale) price directly — most retailers show a struck-through 'original price' next to the sale price, which is the actual number to divide by. (Current price − original price) ÷ original price × 100 gives the true discount percentage on that specific item, regardless of what the sale banner claims for the collection as a whole.
Some retailers inflate the 'original price' shown before marking it down, making the discount percentage look larger than a true apples-to-apples comparison would show — checking the item's price history (browser extensions and some shopping sites track this) is the most reliable way to know whether a listed 'original price' was ever actually charged.
The practical takeaway
Treat 'up to X%' as a ceiling for the entire sale, not an expectation for whatever specific item you're shopping for — check the actual before/after price on that item rather than assuming the headline number applies to it.
